Do I need public liability insurance?

However experienced you are and however careful you may be, there is always the possibility of an incident that could result in a claim being made against you. Public liability insurance will cover you should this eventuality ever occur.

If you employ staff, have trainees or apprentices, or use subcontractors then you are legally required to have employers liability insurance.

An employee is defined in law as any person while working for you in connection with the business who is:

  • Under a contract of service or apprenticeship with you.
  • A person under a contract of service or apprenticeship with some other employer and who is hired to or borrowed by you.
  • A labour master or person supplied by him.
  • A person engaged by a labour only sub-contractor.
  • A self employed person performing work under a similar degree of control and direction by you as a person under a contract of service or apprenticeship with you.
  • A driver or operator of hired-in plant.
  • A trainee or person undergoing work experience.
  • A voluntary helper.

And don’t forget the cover that can be taken as an optional painters insurance extra such as cover for your tools, which if lost or stolen may prevent you from working.
